A trial concerning the Wafi Golpu Environment Permit was heard at the Waigani National Court on 12 June 2025. The plaintiffs, Malatabi Keith Yawing, Grace Kerro, and Councillor Kipu Anonga, appeared on behalf of their communities in Yanga and Wagang (Ahi LLG), and Labu Butu (Wampar LLG). The Conservation and Environment Protection Authority and the State appeared as defendants.
The legal proceedings challenge the validity of the Environment Permit issued on 18 December 2020 for the Wafi Golpu Mine Project. A key aspect raised in the case is the approval of the Deep Sea Tailings Placement (DSTP) system — a proposed pipeline network intended to transport processed mine tailings from the mine site in Mumeng LLG, Bulolo District, through Lae city, and into the Huon Gulf at the Wagang outfall.
During the trial, the plaintiffs argued that the permit authorising the DSTP had been issued outside the scope of the enabling legislation and applicable regulations. They also raised concerns regarding the integrity of the overall approval process. In response, the defendants contended that any deficiencies identified were merely procedural and did not amount to grounds for invalidating the permit.
Justice Purdon-Sully presided over the hearing and has reserved her decision for a date to be advised.
As the matter remains before the Court, no conclusions can be drawn until the final judgment is delivered.
